Who we are
Moment is developed and operated by Anirudh Arikarevula, an individual developer based in New York, USA ("we", "us"). By using withmoment.app or taking part in the Moment beta, you agree to these terms.
The app is licensed by Apple's terms
The Moment app is distributed through the Apple App Store and licensed to you under Apple's Licensed Application End User License Agreement. Purchases, subscriptions, renewals, and refunds are handled by Apple under the Apple Media Services Terms. If anything in these terms conflicts with Apple's agreement as it applies to the app, Apple's agreement governs.
Moment is not medical advice
Moment is a journaling and habit-tracking tool. It is not a medical device, and it does not provide medical, psychological, therapeutic, or other professional advice, diagnosis, or treatment. The insights it shows are statistical patterns drawn from your own entries and, if you connect it, your Apple Health data. They describe correlations across your own days; they are not causes, clinical findings, or recommendations.
Do not rely on Moment to make decisions about your health. If you have concerns about your physical or mental health, consult a qualified professional. If you are in crisis or think you may be in danger, contact your local emergency services immediately.
The beta program
Pre-release versions of Moment are distributed through Apple's TestFlight and are subject to Apple's TestFlight terms. Beta builds are unfinished: they may contain bugs, change without notice, or stop working when they expire, and data entered in a beta may not carry over to the released app. Export your data from Settings if you want to keep it.
Using this website
You may use this site for its intended purpose: learning about Moment, joining the beta, and contacting us. You agree not to interfere with the site, submit abusive or unlawful content through its forms, scrape it, or attempt to gain unauthorized access to it or to the systems that host it.
Ownership
The content and design of this site and the app, including the Moment icon, screenshots, and copy, are ours and are protected by copyright. The Moment name and wordmark are used by us to identify this app, and we claim them as such. You may not copy, modify, or redistribute any of it without our written permission. Your journal is yours: we claim no rights over anything you write in Moment, and we never have access to it. The Fraunces typeface is used under the SIL Open Font License.
Third-party services
This site is hosted by Netlify, and the app is distributed and billed by Apple. Their services are governed by their own terms and privacy policies. We are not responsible for them.
No warranty
To the fullest extent permitted by law, this website and the Moment beta are provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not promise that the site or the beta will be uninterrupted, error-free, or that any insight the app produces is accurate or complete.
Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, arising from your use of this website or the Moment beta. Our total liability to you for any claim relating to this site or the beta will not exceed fifty US dollars (US$50). Nothing in these terms limits liability that cannot be limited under applicable law, or affects consumer rights you have under mandatory local law. Liability relating to the released app is governed by Apple's license agreement above.
Governing law
These terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-law rules. Any dispute relating to this website or the beta will be brought in the state or federal courts located in New York County, New York, and you consent to their jurisdiction, except where mandatory consumer law in your country provides otherwise.
Changes
We may update these terms from time to time. The current version will always be posted at this address with its effective date. Continued use of the site or the beta after a change means you accept the updated terms.
